SPRINGFIELD — A Springfield man who was convicted just last month of domestic assault has been charged with violating his probation after he allegedly attacked the same victim on Christmas Day in front of a young girl.
Charles Swanner, 30, was ordered held without bail Monday after he entered innocent pleas to a new felony count of aggravated domestic assault and to accompanying misdemeanor charges of interference to access with emergency services and violating court-ordered conditions of pretrial release.
On Nov. 4, Swanner had pleaded guilty to misdemeanor domestic assault and received a 3- to 12-month sentence that was suspended so he could participate in “BIP,” the state’s batterer’s intervention program.
Springfield police said they were called to Swanner’s apartment on White Street late on Christmas evening after Swanner allegedly beat a woman while attempting to pry a bottle of her prescription medication away from her.
“He broke my (cell)phone, grabbed me by the shirt and hit my head against the bathroom door,” the complainant wrote in a sworn statement filed with the court.
“He held me down on the bed twice and once put his knee on my jaw and then put his fist in my mouth. My chin is bruised and my head and neck hurt.”
Springfield Police Sgt. Jon Molgano wrote that he was able to photograph several injuries on the victim, who was later treated at the hospital.
Officer Jeremy Fitzgibbons noted that a phone was ripped out of the wall and several objects were strewn about the apartment from an apparent struggle.
“I also noticed a hatchet was sitting on a box in the apartment and what appeared to be a knife handle was sticking out of the same box,” Fitzgibbons noted.
The victim told police that Swanner had threatened to harm himself with the butcher knife and the hatchet if she did not turn over her medication to him.
Fitzgibbons said when he asked Swanner to step outside and explain himself he said he had been helping himself to the victim’s medication for a long time and that he is addicted to it, Fitzgibbons said, adding that in speaking with the defendant the officer noticed that he was unsteady on his feet and that his pupils were very small.
Police charged Swanner with violating his conditions after he allegedly tried unsuccessfully to call the victim from the Springfield jail on four different occasions on Sunday, despite having been told that a temporary no-contact order had been issued while his arraignment was pending.
