Guilty plea in 2010 shooting

A Springfield man charged with firing a gun into a passenger-filled car last spring pleaded guilty Thursday to charges that could send him to jail for up to 15 years.
Timothy P. Decelle, 30, initially pleaded guilty to charges of felony aggravated assault with the intent to knowingly harm another and four misdemeanor counts of reckless endangerment. Those charges all stem from an incident on May 1, 2010, when police say Decelle got into an argument with Keith LaVoie — a man who police said was involved in a four-year grudge with Decelle at the time.
On Tuesday, Decelle pleaded guilty to the reckless endangerment charges and an altered aggravated assault offense that charged him with acting recklessly and without intent to harm others rather than doing so on purpose, according to Windsor County State’s Attorney Robert Sand. Both aggravated assault charges carry the same penalty, he said.
Decelle won’t be sentenced until the state finishes a pre-sentence investigation which could take a few months. Decelle, who was released from jail on $10,000 bond after his arraignment last year, will remain free until his sentencing.
When he does appear in court again, Sand said he will seek a four-year to 15-year jail sentence in accordance with the terms of the plea deal.
The shooting last year took place outside Decelle’s Springfield home. LaVoie and those with him said they had come to Decelle’s home to talk to him, but Decelle told police the visitors had threatened him, his wife and his two children.
Decelle told police that he went into his apartment and grabbed his Smith and Wesson .22-caliber rifle. He fired two shots, although he told police last year he fired into the air, not at the car.
Jenna LaVoie, Keith LaVoie’s wife, was shot in the hip during the incident.
