Gene F. Quick, 31, pled not guilty Tuesday to a misdemeanor count of simple assault on a correction officer with bodily fluids during a Jan. 5 incident reported at the Southern State Correctional Facility. He could have a sentence of up to 2 years imposed with a conviction that will run consecutively, not concurrently, with any other guilty charges. Although the incident occurred in January, the information and police affidavit was filed on this dispute March 6 and was scheduled for arraignment this week. A calendar call for Quick has been penciled in for July 9; he will not have to be transported for the hearing unless the parties reach an agreement or he intends to accept a change of plea. According to an affidavit, the Vermont State Police were requested to investigate reports of an inmate urinating on the leg of an officer at the Springfield-based correctional facility in the late-night hours of Jan. 5. Court records indicate the corrections officer was conducting a tour of the unit and could see Quick standing at his cell door. “I began to write my check down on the check sheet and heard the sound of liquid splashing. I then looked down and could see that inmate Quick was urinating out of the small crack of his food chute onto my leg,” the affidavit reads, referring to the corrections officer by only his last name of Abatiell. “I quickly moved my leg out of the way. Inmate Quick then began to laugh about the fact that he urinated on me.” VSP Detective Sgt. Richard Holden responded to the prison on Jan. 30 to interview the suspect. “When I asked Quick if I could talk with him about assaulting a correctional officer, and he replied ‘Which time?’ He then declined to be interviewed,” Holden wrote in his affidavit. This is not the first time Quick, who was born in San Diego, Calif., has had run-ins with correctional officers. In August 2012, he attacked an officer in the Foxtrot Unit of Springfield facility when he requested entry to the recreational area. As Quick entered the pen, he struck the guard on the left side of his head. Quick was swiftly secured by other corrections officers, who found the inmate’s handcuffs were not properly fastened and he was able to use them as a weapon consistent with brass knuckles. The officer sustained a laceration to the side of his head and was treated at Springfield Hospital. State police said Quick was convicted of his second offense of simple assault on a law enforcement officer in April 2013.
Will the guard file for PTSD disability because of this bogus assault? I can't wait for the trial; "Your Honor, this heinous villain go wee wee on my knee". The guard should be embarrassed and so should the clowns that are prosecuting this nonsense.
