Aaron Montgomery Sr., 27, twisted from side-to-side and repeatedly raised his handcuffs up-and-down during the roughly ten-minute-long hearing as he watched his public defender, attorney Robert Lees, enter innocent pleas on his behalf to a new felony count of sale of heroin and to a misdemeanor count of heroin possession. During the first week of this month Montgomery entered innocent pleas to two felony counts alleging that earlier this year he'd sold heroin from his room upstairs in a house right next to the entrance to the Union Street Elementary School. Following that first arraignment, Montgomery had been released from the courthouse in downtown White River Junction once he signed for a $5,000 unsecured appearance bond and another $1,000 was added to that total on Friday, largely because Montgomery is due back in court early next month for what both the state and the defense expect will be a "global" plea deal resolving his entire slate of charges. "He does seem to have a sincere interest in resolving these cases," Lees told Judge Theresa DiMauro, adding that Montgomery understood "some period of incarceration" was likely to be part of any final agreement. While the charges earlier this month came from investigations carried out by the Vermont Drug Task Force, the new charges were filed by the Springfield Police Department. The felony count alleges that in March Montgomery was seen selling at least one bag of heroin to another man at the Springfield Shopping Plaza and the misdemeanor charge stems from an incident in May when an officer pulled up to speak with Montgomery, who was walking up Park Street at the time, and reported that two bags of heroin fell out of Montgomery's pants onto the sidewalk when Montgomery emptied his pockets in order to show that he didn't have any heroin on him.
